These Terms and Conditions settle the relations between Beauty Commerce Ltd on the one hand, and the Users of the websites and services located on the Site https://laboreight.com (hereinafter referred to as Users), on the other. Beauty Commerce Ltd is a company registered under the Commercial Law of the Republic of Bulgaria with UIC 201471142, with registered office and management address: Sofia, Tintyava 86 street, phone: +35987 844 4011.
When using this website, the general terms and conditions are applicable and settle the relations between the owner of the website, Beauty Commerce Ltd. and Users and buyers of the goods offered.
The general terms and conditions are binding for both parties in the legal relations arising between them in connection with the use of the website, from the moment of commencement of its use, which occurs with the opening of the electronic portal https://laboreight.com by the User.
Please read the published Terms and Conditions in full before using the information and commercial services offered on the Site (hereinafter referred to as Services). By viewing the Site, each User automatically binds himself/herself to the Terms and Conditions described below.
Confirmation of the General Terms and Conditions is a necessary and mandatory condition for the conclusion of the contract between the User and Beauty Commerce Ltd. By accepting the General Terms and Conditions, the User agrees to the processing of his personal data on the basis of the contract concluded between him and Beauty Commerce Ltd. Such data are name, telephone, address and email. The User Privacy Policy, an integral part of these General Terms and Conditions, is also posted prominently on the website https://laboreight.com.
II. Definitions
For the purposes of these General Terms and Conditions, the following terms are to be understood in the following sense:
Website - https://laboreight.com and all its subpages.
User - means any natural or legal person who acquires goods or uses services not intended for the performance of a commercial or professional activity, and any natural or legal person who, as a party to a contract under this Act, acts outside the scope of his commercial or professional activity.
Terms and Conditions - these Terms and Conditions, which include terms of use, privacy policy, cookies, registration and delivery rules, voluntary dispute resolution, cancellation form and any other legally relevant information found on the site.
Personal data - any information about an individual that reveals his or her physical, psychological, mental, family, economic, cultural or social identity.
Goods - movable tangible property, with the exception of goods sold under the order of enforcement or by other measures by the authorities authorized by law, as well as goods abandoned or confiscated for the benefit of the state, declared for sale by state authorities.
Purchase and sale contract - a contract under which the trader transfers or undertakes to transfer the ownership of goods to the User and the User pays or undertakes to pay the price for them, including contracts having as their object both goods and services.
Alternative User dispute resolution procedure - a procedure for the out-of-court resolution of User disputes, meeting the requirements of a specific law or a specific agreement between the parties to a legal relationship, carried out by an alternative User dispute resolution body/arbitrator, mediator or others.
III. Registration and conclusion of purchase contract
You can order from https://laboreight.com as a guest or as a registered User. Orders are accepted on the site 24 hours a day, 7 days a week, including weekends and public holidays. In order to generate an order through the site, it is not necessary to register a User account.
In case you choose to place an order through registration, you must select a unique Username and password, and provide a shipping address, first and last name, e-mail, contact telephone number(s), at which time your details will be saved in our system. After successful registration and storage of your details in the system, you will be able to change your delivery address and personal details with each new order, as well as designate a representative to take your order if required.
If you choose to place an order as a guest, you should provide your delivery addrеss, first and last name, e-mail, contact telephone number(s).
In order to purchase products from the https://laboreight.com online store, you submit personal information. This information is protected by the Data Protection Act and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. The Seller uses the personal information in order to improve the services offered to you. The information you submit is used solely to fulfil your order.

In case of technical errors made by the User in the information provided by him when placing the order, the seller (site) has the right to refuse the order without compensation to the User. In case of amounts paid by the User for a specific order(s) that for the above reasons cannot be fulfilled, the Seller (site) shall be obliged to refund them, deducting from the amount paid the transport costs, insurance and bank charges.
Upon completion of the order, the User has the opportunity to review the products he has decided to purchase, their prices and the final payment amount. Before finalizing the order, the User should note that he agrees to these Terms and Conditions and the Privacy Policy of the Site.
After finalizing and sending the order, a confirmation will be sent to the e-mail address provided with the record of the entered information. For each stage of the order processing (confirmation of availability, dispatch, etc.) the User will be notified by an operator by e-mail or telephone.
An order placed through the website is a draft purchase contract. The order is valid for 7 days and we will confirm receipt of the order by e-mail within this period. The contract is considered as concluded from the moment of order confirmation.
Beauty Commerce Ltd. has the right to refuse to conclude a contract with an incorrect User, and the company has the right to treat a User as incorrect in cases where:
- there is non-compliance by the User with the General Terms and Conditions;
- there is an incorrect, arrogant or rude attitude towards the seller's representatives.
- systematic /three or more times/ abuses by the User towards Beauty Commerce Ltd. are established.
IV. Price and payment method
The prices of the goods offered are those indicated on the seller's website - https://laboreight.com at the time of ordering. The prices of the goods include VAT in cases where it is stipulated to charge it.
The Seller (website) has the right to change prices at any time without prior notice to Users. The User is obliged to pay the price that was current at the time of placing the order.
The final price of the goods is displayed on the presentation page of the respective product. The cost of shipping is not included in the price of the goods. It is stated separately in the order and is added to the price of the goods when determining the final price to be paid.
Beauty Commerce Ltd. may provide discounts for the goods offered on the website https://laboreight.com, in accordance with Bulgarian legislation and rules set by Beauty Commerce Ltd. The rules for such discounts are available at the place where the discount is displayed. Discounts may be presented in different forms (e.g. promotions, loyalty discounts presented individually, randomly or as a result of participation in a competition or customer survey, discount coupon, customer card, etc.). Different types of discounts cannot be combined when ordering and purchasing the same item.
The User may pay the price of the ordered goods using one of the options listed on the Site. On the Site it is possible to make the payment in one of the following ways:
- Bank transfer: Payment of the amount due is made via bank transfer to the bank account specified by https://laboreight.com. This method of payment can be used either by a regular bank transfer made at the bank branch or by using internet banking. With this payment method, after order confirmation, the amount due is paid in advance by bank transfer. The User has to transfer the amount of the order and the shipping amount. The User will be notified by e-mail or telephone of the availability of the items and the final amount of the transfer, after which he/she should make the bank transfer. Bank transfer fees are the responsibility of the customer and are in the amount determined by the bank chosen by the User. The ordered product shall be shipped once the order amount is credited to the bank account of Beauty Commerce Ltd. In this case, the delivery period starts from the date of receipt of the order amount in the seller's bank account.
- Cash on delivery: Upon receipt of the goods, the User pays the amount due to the courier. The cash on delivery payment service is only active for the territory of the Republic of Bulgaria.
- Payment by card (online): After completing the order, the User will be transferred to the myPOS system where the payment will have to be made. After reporting a successful or unsuccessful payment, the User will again be transferred to https://laboreight.com. The payment instrument data of the Users is processed by myPos AD, myPOS World Lttd. in London, United Kingdom and the group companies. V. Delivery
All goods ordered from https://laboreight.com for the territory of the Republic of Bulgaria are delivered by courier company "Speedy" AD. The ordered goods for countries outside the territory of the Republic of Bulgaria are delivered by courier companies "Direx" EAD and "Speedy" AD.
The delivery of the ordered goods is carried out by courier to the office or delivery address specified by the User on the territory of the Republic of Bulgaria. Delivery is at the expense of the User, unless otherwise expressly stated on the Site.
The cost of standard delivery within the territory of the country is 5.99 BGN including VAT. The quoted price is indicative and is determined by the current tariffs of the supplier.
The delivery time is 3 working days after order confirmation.
The delivery time quoted is indicative and based on the courier company's usual delivery time.
Free delivery for orders over 100.00 BGN including VAT.

Note: With one order can be delivered up to 3kg of goods. In the event that this limit is exceeded, users should generate a new order. The restriction applies to the following countries: Romania, Greece, Cyprus, Poland, Slovenia, Slovakia, Czech Republic, Hungary, Croatia. For all other countries goods can be delivered with one order up to 5 kg, in case this limit is exceeded, users should generate a new order.
In extraordinary circumstances Beauty Commerce Ltd reserves the right to extend delivery times.
Each product purchased is insured for damage caused during transport. If the recipient is absent from the delivery address, does not answer the phone number left with the order, or the phone number is wrong, the order will be deposited until further notice at the courier company's office for a period of 7 days. If the order is not claimed within this period, it will be canceled and the seller (website) is released from the obligation to make the delivery.
In case the customer has prepaid for his order, Beauty Commerce Ltd. shall refund the amount paid within 14 days from the date of cancellation of the order.
VI. Withdrawal and replacement
According to the legislation, every User has the right to withdraw from a contract concluded by telephone or on the Internet without giving a reason within 14 /fourteen/ days of delivery of the goods.
In order to exercise the right of withdrawal, the User must notify the Seller (website), indicating his name and address for correspondence, telephone number and email address, as well as his decision to withdraw from the contract with an unequivocal application, which must be submitted to the Seller in paper form or sent to the email address: This email address is being protected from spambots. In case that the User withdraws from the contract, Beauty Commerce Ltd will refund all payments, including the cost of standard delivery (if any), within 14 days from the date on which the User is informed of the User's decision to withdraw from the contract.
In case of withdrawal from the contract, the transport costs for the return of the goods shall be paid by the User.
If the user decides to use a freight forwarder other than the one specified in these terms and conditions, which uses the seller, to return the products, the user will have to personally pay the necessary costs and will be liable if the products are lost or damaged during shipment, in accordance with the methods and conditions governing the right of withdrawal.
The amount of the transport costs for the return of the goods (standard delivery for the territory of the Republic of Bulgaria) shall be deducted from the refundable amount.Beauty Commerce Ltd. makes refunds only to the User's bank or card account. In case of payment by cash on delivery, the amount shall be refunded to the bank account specified by the User. In case the payment is made by bank card, the refund shall be made by ordering a reverse transaction on the card with which the payment was made.
Beauty Commerce Ltd. shall have the right to postpone the refund of payments until the goods have been received back or until proof has been provided that the goods have been sent back, whichever is the earlier.
The User must send back the goods no later than 14 days from the day on which he informed the seller of his withdrawal from the contract.
The deadline is deemed to have been met if the User sends the goods back to the seller before the expiry of the 14-day period.
The goods must be returned in their original packaging in their entirety, complete and undamaged.
Users should note that they are legally liable for any diminution in the value of the goods resulting from their use in a manner other than that necessary to become familiar with their nature, properties and functionality (e.g. if you use a perfume even after you have already tried it, if a product has torn packaging or removed cellophane/packaging). Users should also be aware that they do not have the right to withdraw from the contract if the goods have been manufactured to their requirements or are personalized (e.g. packaging with personalized engravings) and for goods that have been removed from their packaging and which cannot be put back into the packaging for hygiene reasons (e.g. opened cosmetic products and other goods that come into direct contact with the skin).
VII. Non-conformity of goods and claims
Customized products can only be returned if they are defective. The customer can only send back items from the country where the order was placed.

The User has the right to claim for any non-conformity of the goods with the agreed/ordered, when after delivery discrepancies with the contract of purchase are found.
The User may not contest the conformity of the User goods with the contract of purchase where he knew or could not have been unaware of the non-conformity when concluding the contract.
The User should pay attention upon receipt of the shipment by checking the goods in the presence of the courier for the conformity of the goods with the order placed. In case of any shortages, defects or non-conformity of the goods received with those ordered, Beauty Commerce Ltd shall replace the products at its own expense at no additional charge to the User.
A claim for a damaged shipment shall be made at the time of receipt of the shipment and in the presence of the courier, as this shall be noted with a remark in the bill of lading and with a completed on-site inspection report in duplicate. The report of inspection shall be binding for the validity of the damage and shortages covered by the insurance. The User or consignee of the shipment must attach the copy when completing a return request.

When claiming a product, the User may claim a refund, a replacement of the product with another that corresponds to the agreed price or a discount.
VIII. Termination and cancellation of the contract
Beauty Commerce Ltd. shall have the right to terminate the contract unilaterally at its own discretion, without giving notice, in case it finds that the services provided are being used in violation of these General Terms and Conditions, the legislation in the Republic of Bulgaria and/or generally accepted moral standards.
Except in the cases provided for in these General Terms and Conditions, the contract between the parties shall also be terminated in case of the discontinuation of the activity of Beauty Commerce Ltd or the discontinuation of the maintenance of its website https://laboreight.com
Except as provided above, either party may terminate this Contract by giving one week's notice to the other party in case of default under the Contract.
The written form of the contract shall be deemed to have been complied with by sending a message by electronic mail (e-mail), pressing an electronic button on a content page that is filled in or selected by the User or ticking a box (check box) on the website, etc., as long as the statement is recorded technically in a way that makes it possible to reproduce it.
IX. Invalidity of individual contract clauses
The parties declare that in case of any provision(s) of these Terms and Conditions shall prove to be invalid, this shall not invalidate the whole or any other part of the Contract. The invalid clause will be superseded by mandatory rules of law or established practice.
X. Intellectual property
The intellectual property rights in all materials and resources located on the website https://laboreight.com (including the available databases) are protected under the Copyright and Related Rights Act, belong to Beauty Commerce Ltd or to the appropriately designated person who has assigned the right of use to Beauty Commerce Ltd and may not be used in violation of applicable law. In case of copying or reproduction of information outside the permissible scope, as well as in case of any other violation of intellectual property rights on the resources of Beauty Commerce Ltd, Beauty Commerce Ltd shall be entitled to claim compensation for direct and indirect damages in full.
Except where expressly agreed, the User may not reproduce, modify, delete, publish, distribute or otherwise disclose the information resources published on the website https://laboreight.com

XII. Disputes
These General Terms and Conditions of Sale are governed by Bulgarian law.
Alternative Dispute Resolution (ADR) between consumers and traders is an out-of-court conciliation procedure on a voluntary basis.The Joint Conciliation Commissions facilitate the settlement of disputes between consumers and traders concerning contracts for the sale of goods and the provision of services.
The General Conciliation Commissions are appointed on a regional basis and the General Conciliation Commission of the Consumer Protection Commission, with its seat in the city of Beauty Commerce Ltd. The Consumer Protection Commission is located in Sofia, Sofia Region, Kyustendil Region and Pernik Region.

In the case of an international sale, any disputes or complaints relating to the General Terms and Conditions of Sale arising between a customer and a seller shall be settled by the courts of the place where the customer is domiciled or by the courts of the seller's registered office.
In the case of a sale within the territory of the country, all disputes or complaints relating to the General Terms and Conditions of Sale arising between a consumer and a seller shall be settled by the competent Bulgarian court.
